By accessing or using Deadpipe ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

These Terms constitute a legally binding agreement between you and Deadpipe. We may modify these Terms at any time, and your continued use of the Service constitutes acceptance of the modified Terms.

2. Description of Service

Deadpipe is a data observability platform that provides:

  • Pipeline monitoring through heartbeat signals
  • API and application performance monitoring
  • Real-time dashboards and analytics
  • Alerting and notification systems
  • Webhook-based integrations

The Service is available in both hosted and self-hosted configurations.

3. User Accounts

3.1 Account Creation

To use certain features of the Service, you must create an account. You are responsible for:

  • Providing accurate and complete information
  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized access

3.2 Account Types

  • Free Tier: Limited monitoring and basic features
  • Pro Plan: Enhanced monitoring with advanced features
  • Team Plan: Multi-user collaboration and enterprise features
  • Self-hosted: Full control with local deployment

4. Acceptable Use Policy

4.1 Permitted Use

You may use the Service to monitor:

  • Your own data pipelines and applications
  • Systems you have authorization to monitor
  • Development, staging, and production environments

4.2 Prohibited Activities

You may not:

  • Monitor systems without proper authorization
  • Use the Service for illegal activities or to violate laws
  • Attempt to reverse engineer, decompile, or disassemble the Service
  • Interfere with or disrupt the Service or other users
  • Use excessive API calls that impact service performance
  • Share account credentials or API keys
  • Transmit malicious code, viruses, or harmful content
  • Use the Service to monitor or collect personal data without consent

5. Data and Privacy

5.1 Data Ownership

You retain ownership of all data you submit to the Service. We claim no ownership rights to your data.

5.2 Data Processing

By using the Service, you grant us permission to process your data solely for providing the Service. We will handle your data in accordance with our Privacy Policy and applicable data protection laws.

5.3 Data Retention

You control data retention settings in your account. Default retention is 90 days for monitoring data. We may retain account data longer as required by law or for legitimate business purposes.

6. Payment Terms

6.1 Billing

Payment is required for Pro and Team plans. Billing occurs monthly or annually based on your selection.

6.2 Pricing

  • Free: $0/month - Basic monitoring
  • Pro: $29/month - Advanced monitoring
  • Team: $99/month - Multi-user collaboration

6.3 Payment Methods

We accept major credit cards and other payment methods as displayed in your account. You authorize us to charge your payment method for all fees incurred.

6.4 Late Payments

If payment is not received by the due date, we may suspend or terminate your access to paid features. Late fees may apply for overdue accounts.

6.5 Refunds

All payments are final. We do not provide refunds for partial months or unused service time. Contact support for billing-related issues.

7. Intellectual Property

7.1 Our Rights

The Service and all related technology, trademarks, and content are owned by Deadpipe and protected by intellectual property laws. You receive only a limited license to use the Service.

7.2 Your Content

You retain ownership of your data and content. By using the Service, you grant us a limited license to process and display your data for service provision.

8. Service Availability and Support

8.1 Uptime

We strive for high availability but do not guarantee uptime. Self-hosted deployments depend on your infrastructure.

8.2 Support

Support is provided through email and documentation. Response times vary by plan:

  • Free: Community support
  • Pro: Email support within 24 hours
  • Team: Priority email support within 12 hours

8.3 Service Changes

We may modify, suspend, or discontinue the Service with reasonable notice. We will not be liable for service interruptions or changes.

9. Termination

9.1 Termination by You

You may terminate your account at any time. Paid plans will not be refunded for the current billing period.

9.2 Termination by Us

We may terminate or suspend your account for violations of these Terms, illegal activity, or non-payment. We will provide notice when possible.

9.3 Effect of Termination

Upon termination, your access to the Service ends. We may retain your data as required by law or for legitimate business purposes.

10. Disclaimers and Limitations of Liability

10.1 Service Disclaimers

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.

10.2 Monitoring Limitations

Deadpipe monitors based on the data you provide. We do not guarantee detection of all issues or that alerts will be delivered successfully. You are responsible for your monitoring strategy.

10.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU FOR THE SERVICE IN THE 12 MONTHS PRECEDING THE CLAIM.

WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, DATA, OR BUSINESS OPPORTUNITIES.

11. Indemnification

You agree to indemnify and hold harmless Deadpipe from any claims, damages, losses, or expenses arising from:

  • Your use of the Service
  • Violation of these Terms
  • Infringement of third-party rights
  • Illegal activities conducted using your account

12. Governing Law and Dispute Resolution

12.1 Governing Law

These Terms are governed by the laws of Sweden, without regard to conflict of law principles.

12.2 Dispute Resolution

Any disputes will be resolved through binding arbitration in Sweden. You waive your right to participate in class action lawsuits.

13. Miscellaneous

13.1 Severability

If any provision of these Terms is found invalid, the remaining provisions remain in effect.

13.2 Entire Agreement

These Terms constitute the entire agreement between you and Deadpipe regarding the Service.

13.3 Waiver

Our failure to enforce any provision does not constitute a waiver of that provision.

13.4 Assignment

You may not assign your rights under these Terms. We may assign our rights to affiliates or successors.
